Otesse LLC ("Otesse," "we," "us," or "our") is committed to sending email and SMS communications responsibly and in full compliance with applicable anti-spam and telecommunications regulations. This Anti-Spam Policy describes our practices regarding commercial electronic messages and text messages sent through or in connection with our field service management platform and related services (the "Services").
1. Email Communications — CAN-SPAM Compliance
Otesse complies with the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 ("CAN-SPAM Act"), 15 U.S.C. Sections 7701-7713, and the Federal Trade Commission's implementing regulations.
1.1 Types of Email We Send
We send two categories of email:
Transactional Emails — Messages that facilitate, complete, or confirm a transaction you have already agreed to, or provide information about an ongoing business relationship. These include:
- Account verification and password reset emails
- Booking confirmations and appointment reminders
- Invoice and payment receipt emails
- Subscription renewal notices
- Service status updates (en route, completed, etc.)
- Account security alerts (login from new device, password changes)
- Changes to our Terms of Service, Privacy Policy, or other legal agreements
Commercial/Marketing Emails — Messages whose primary purpose is to advertise or promote Otesse services, features, or offers. These include:
- New feature announcements
- Promotional offers and discounts
- Newsletters and company updates
- Re-engagement campaigns for inactive accounts
- Referral program invitations
1.2 Our CAN-SPAM Commitments
For all commercial/marketing emails, Otesse:
- Does not use false or misleading header information. The "From" name and email address accurately identify Otesse as the sender.
- Does not use deceptive subject lines. Subject lines accurately reflect the content of the email body.
- Identifies the message as an advertisement when required, clearly and conspicuously.
- Includes our physical mailing address in every commercial email: Otesse LLC, Oregon, USA.
- Provides a clear and conspicuous unsubscribe mechanism in every commercial email, typically a one-click "Unsubscribe" link at the bottom of the email.
- Honors unsubscribe requests within 10 business days of receipt, as required by law. In practice, we process most unsubscribe requests within 24 hours.
- Does not sell or transfer email addresses to third parties for their own marketing purposes.
- Does not charge a fee or require any information beyond the email address to process an unsubscribe request.
1.3 Opt-In for Marketing Emails
We send commercial/marketing emails only to users who have opted in to receive them. You may opt in during account creation or at any time through your notification preferences in the customer portal. You may opt out at any time by:
- Clicking the "Unsubscribe" link in any marketing email
- Updating your notification preferences in Settings > Notifications in your portal
- Emailing hello@otesse.com with subject "Unsubscribe from Marketing"
Opting out of marketing emails does not affect transactional emails, which are necessary for the operation of your account.
2. SMS / Text Message Communications — TCPA Compliance
Otesse complies with the Telephone Consumer Protection Act of 1991 ("TCPA"), 47 U.S.C. Section 227, and the Federal Communications Commission's implementing regulations regarding text messages (SMS and MMS).
2.1 Types of SMS We Send
Transactional SMS — Time-sensitive messages related to your active bookings and account:
- Appointment reminders (24 hours and 1 hour before service)
- Technician en-route notifications
- Service completion notifications
- Account security codes (two-factor authentication)
- Urgent service-related updates (rescheduling due to weather, etc.)
Marketing SMS — Promotional messages about offers, discounts, or new services. These are sent only with your explicit prior consent.
2.2 Consent Requirements
Transactional SMS: When you provide your phone number during account creation and acknowledge our Terms of Service, you consent to receive transactional text messages related to your use of the Services. This consent is implied as part of the service relationship.
Marketing SMS: We obtain your express written consent before sending any marketing text messages. Consent is obtained through:
- A clear, conspicuous checkbox during account creation or at opt-in prompts within the portal (not pre-checked)
- The checkbox text clearly states: "I agree to receive promotional text messages from Otesse. Message and data rates may apply. Reply STOP to unsubscribe."
- Consent is documented with a timestamp and the specific language presented
2.3 Opt-Out for SMS
You may opt out of SMS communications at any time by:
- Replying STOP to any text message from Otesse. You will receive a single confirmation message and no further texts will be sent.
- Updating your notification preferences in Settings > Notifications in your portal.
- Contacting us at hello@otesse.com with subject "SMS Opt-Out."
We honor all opt-out requests immediately. After opting out, you will receive a one-time confirmation that your request has been processed.
2.4 Message Frequency and Costs
- Transactional SMS frequency depends on your booking activity (typically 2-4 messages per scheduled service).
- Marketing SMS, if opted in, is limited to no more than 4 messages per month.
- Standard message and data rates from your wireless carrier may apply. Otesse does not charge for text messages.
2.5 Do Not Call / Do Not Text
Otesse maintains internal do-not-contact lists. If you opt out of SMS, your phone number is added to our suppression list and will not receive further text messages of the opted-out category. We also comply with the National Do Not Call Registry to the extent applicable to our communications.
3. Prohibited Practices
Otesse strictly prohibits the following practices, both internally and for any users of our platform who send communications through or in connection with our Services:
- Sending unsolicited bulk email or text messages (spam)
- Harvesting or collecting email addresses or phone numbers from the platform for the purpose of sending unsolicited messages
- Using false or misleading sender information, headers, or subject lines
- Sending messages to purchased or rented email lists
- Failing to include a working unsubscribe mechanism in commercial messages
- Failing to honor opt-out requests within the legally required timeframe
- Sending marketing messages without proper consent
4. Enforcement
Otesse enforces this Anti-Spam Policy through:
- Technical safeguards — Rate limiting on outbound messages, automated monitoring for spam-like patterns, and content filtering.
- Account penalties — Users of the platform who violate this policy may have their messaging privileges suspended or their accounts terminated.
- Reporting — If you receive an unwanted message that you believe originated from or through Otesse, please report it to hello@otesse.com with subject "Spam Report."
5. Third-Party Email Services
Otesse uses Postmark (by ActiveCampaign) as our transactional email delivery provider. Postmark enforces strict anti-spam policies and is compliant with CAN-SPAM requirements. All emails sent through Postmark include proper authentication (SPF, DKIM, DMARC) to help prevent spoofing and improve deliverability.
6. Changes to This Policy
We may update this Anti-Spam Policy from time to time. Material changes will be communicated through the Services or via email. The "Last Updated" date at the top indicates the most recent revision.
