Otesse LLC ("Otesse," "we," "us," or "our") respects the intellectual property rights of others and expects all users of our platform and services (the "Services") to do the same. This policy describes our procedures for responding to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998, 17 U.S.C. Section 512 (the "DMCA").
1. Reporting Copyright Infringement
If you believe that content hosted on or accessible through the Otesse platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent. To be effective, the notice must be a written communication that includes the following information:
1.1 Required Elements of a DMCA Notice
- Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list.
- Identification of the infringing material — A description of the material that you claim is infringing and that you want removed or access disabled, with sufficient detail to allow us to locate the material. This should include the URL(s) or other specific location(s) on the Services where the infringing material can be found.
- Your contact information — Your name, mailing address, telephone number, and email address so that we can contact you about your complaint.
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature — A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.
1.2 Where to Send DMCA Notices

We will process all valid DMCA notices and take appropriate action in accordance with the DMCA.
2. How We Respond to DMCA Notices
Upon receiving a valid DMCA takedown notice, Otesse will take the following steps:
- Acknowledge receipt — We will confirm receipt of your notice within 2 business days.
- Remove or disable access — We will expeditiously remove or disable access to the allegedly infringing material.
- Notify the alleged infringer — We will make a good faith attempt to notify the user who posted or uploaded the content that it has been removed or disabled due to a copyright infringement claim. We will provide the user with a copy of the takedown notice (with your personal contact information redacted unless required) and information about their right to file a counter-notification.
- Document the action — We will maintain records of DMCA notices received and actions taken for compliance purposes.
3. Counter-Notification
If you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. A valid counter-notification must include:
- Identification of the removed material — A description of the material that was removed or to which access was disabled, and the location where it appeared before removal.
- Your contact information — Your name, mailing address, telephone number, and email address.
- Consent to jurisdiction — A statement that you consent to the jurisdiction of the U.S. District Court for the judicial district in which your address is located (or, if your address is outside the United States, the U.S. District Court for the District of Oregon), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
- Good faith statement — A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Signature — Your physical or electronic signature.
3.1 Counter-Notification Process
Upon receiving a valid counter-notification:
- We will forward a copy of the counter-notification to the original complainant.
- We will inform the complainant that we will restore the removed material in 10 to 14 business days unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in the allegedly infringing activity.
- If we do not receive such notice within 14 business days, we will restore the removed material.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Otesse maintains a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances.
4.1 Strike System
Otesse implements the following strike system:
- First offense: The infringing content is removed and the user receives a written warning explaining the violation and the consequences of further infringement.
- Second offense: The infringing content is removed, the user receives a second written warning, and the user's ability to upload or share content may be temporarily restricted.
- Third offense: The user's account is permanently terminated and access to all Services is revoked. This decision is made at Otesse's sole discretion and may be appealed by contacting hello@otesse.com within 14 days.
4.2 Egregious Cases
In cases of willful, large-scale, or particularly egregious infringement, Otesse reserves the right to terminate a user's account immediately without following the graduated strike system described above.
5. Misrepresentation Warning
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. If you are unsure whether the material at issue is infringing, we recommend consulting an attorney before submitting a DMCA notice or counter-notification.

7. Modifications
Otesse may update this DMCA/Copyright Policy from time to time. Material changes will be communicated by updating the "Last Updated" date at the top of this page.
